  • [4 - SH] French Group Launches Class Action Against Google Over Data Privacy

[4 - MID] A French consumer rights group said Wednesday that it has launched a class action lawsuit against US tech giant Google for violating the EU's strict data privacy laws. [4 - COM] A French consumer rights group said Wednesday that it has launched a class action lawsuit against US tech giant Google for violating the EU's strict data privacy laws. The UFC-Que Choisir group said in a statement that the goal of its class action is to "end the insidious exploitation of users' personal data, particularly those using Android devices with a Google account, and compensate them for up to EUR 1,000 ($1,135)". "This compensation claim is a first in France as well as Europe," UFC-Que Choisir president Alain Bazot told AFP. "If the judge rules in favour, there are potentially 28 million Android users in France that could be entitled to compensation," he added. So far 200 people have joined the class action, said Bazot. Google said it had not yet received details concerning the case and declined to comment for time being. The class action comes after the internet behemoth suffered two recent blows in France. In January, France's CNIL data watchdog slapped Google with a record EUR 50 million fine for failing to meet the EU's tough General Data Protection Regulation (GDPR), which came into force in May last year. Then in February, the Paris district level court ordered Google to remove "abusive" clauses from the service conditions it requires consumers to accept. 'Invasion of privacy' UFC-Que Choisir on Wednesday accused Google of "drowning consumers in endless confidentiality rules" and "maintaining a veritable obstacle course" when it comes to users' geolocation. "It's a real invasion of privacy," said Bazot, adding that "even when you do not use Google's services, your phone geolocates you 340 times a day!" The consumer group said it had tried to reach an amicable agreement but had been unsuccessful, so launched the class action suit in Paris against Google Ireland, the internet giant's European hub, and Google LLC. Bazot did not expect a quick outcome, saying the procedure could take seven to eight years, or more. Another non-governmental organisation that defends the rights of internet users has also signalled it plans to file a lawsuit against Facebook. The choice of going through the courts, as opposed to making a complaint to the CNIL watchdog, means that the case remains in France. CNIL refers certain cases to the regulator in the EU country where the company is registered in the bloc. Bazot said pursuing class action lawsuits also means potentially larger fines that would be dissuasive for massive internet firms, calling the EUR 50 million CNIL fine no more than a "mosquito bite" for Google. Google's parent company Alphabet earned a first-quarter net profit of $6.7 billion (EUR 5.9 billion) on revenue of $36.3 billion.

[5 - COM] The European Union opened Wednesday an investigation to determine whether US semi-conductor giant Broadcom may be violating the bloc's competition rules and hurting rivals. Pending the probe's outcome, the European Commission, the EU's executive arm, said it would seek interim steps to stop the alleged practices and avert irreparable harm. The investigation centres on the markets of TV and modem chipsets, devices that offer television and internet access to customers at home or work. "We suspect that Broadcom, a major supplier of components for these devices, has put in place contractual restrictions to exclude its competitors from the market," Competition Commissioner Margrethe Vestager said. "This would prevent Broadcom's customers and, ultimately, final consumers from reaping the benefits of choice and innovation," Vestager added. "We also intend to order Broadcom to halt its behaviour while our investigation proceeds, to avoid any risk of serious and irreparable harm to competition," she said. The commission said it has obtained information that Broadcom may be requiring firms to buy only its components, or granting them rebates and other advantages if they buy set quantities. The commission said it had also heard Broadcom may be bundling products or purposely undermining the "interoperability" between Broadcom products and other products. The commission said Wednesday it has sent a "statement of objections on interim measures" to Broadcom requiring it to swiftly stop such alleged practices. Broadcom has two weeks to respond to the allegations and convince the commission that its practices are not in fact restricting the business of its rivals. If Broadcom fails to convince the commission, the interim measures will remain in place until the investigation is concluded, officials said. The commission said urgent action is needed because the firm's alleged practices could do lasting harm. "The Commission found that the alleged competition concerns were of a serious nature and that Broadcom's conduct may result in the elimination or marginalisation of competitors before the end of proceedings," it said.

[6 - COM] Facebook has rolled out its transparency tools globally for advertisers wanting to place ads about social issues, elections or politics. The social networking platform already requires that advertisers get authorised and add disclaimers to political ads in over 50 countries and territories, including in India. "Now we're expanding proactive enforcement on these ads to countries where elections or regulations are approaching, starting with Ukraine, Singapore, Canada and Argentina," Sarah Schiff, Product Manager at Facebook said in a blog post on Tuesday. As part of the authorization process for advertisers, Facebook confirms their ID and allow them to disclose who is responsible for the ad, which will appear on the ad itself. The ad and "Paid for by" disclaimer are placed in the Ad Library for seven years, along with more information such as range of spend and impressions, as well as demographics of who saw it. "The authorization process will not change in countries where we've previously launched, and people who previously authorized will not need to reauthorize," said the company. "Beginning today, we will systematically detect and review ads in Ukraine and Canada through a combination of automated and human review. In Singapore and Argentina, we will begin enforcement within the next few months," said Facebook which also plans to roll out the Ad Library Report in both of those countries after enforcement is in place. "We're also rolling out access to our Ad Library API globally so regulators, journalists, watchdog groups and other people can analyze ads about social issues, elections or politics and help hold advertisers and Facebook accountable," said Facebook. In countries where Facebook is not yet detecting or reviewing these ads, "these tools provide their constituents with more information about who's influencing their vote -- and we suggest voters and local regulators hold these elected officials and influential groups accountable as well".

[7 - COM] Micro-blogging site Twitter is trying new ways to improve the 'Lists' feature on its platform. The company on Tuesday announced that it has begun testing to make the feature easier to use. The feature, remained buried inside Twitter's interface, is intended to let users create custom timelines by adding specific users whose tweets a user is interested to track. "Customisable timelines that are easy to access? We're thinking about ways to do this! One idea we had is for you to be able to swipe to your lists from home. If you're in the test tell us what you think," Twitter posted on its handle. The announcement gathered positive responses from the users. "This is an excellent idea. Being able to order the lists would be important too. If anything makes it a toggle in Lists so we can have it if we want," a user posted. "Love this. Many people don't even know about lists. I use lists all the time to cut through the noise. This is a great fix! Love the ease of access," wrote Kyle Harris, renowned vlogger and social media commentator. As of now, Twitter has not specified how many people would be added to the test. Currently, the test is available in Twitter's mobile app for those who have been opted in, TechCrunch reported.
